SARS Must Now Explain Itself – A Landmark Victory for South African Taxpayers

A recent Supreme Court of Appeal judgment has delivered an important reminder to both taxpayers and SARS: fairness and transparency matter.
In the case of QI Logistics v SARS, the taxpayer submitted extensive supporting documentation during a customs dispute. SARS rejected the taxpayer's explanation but failed to properly explain why the evidence had been disregarded. When the matter reached the Supreme Court of Appeal, the Court made it clear that this was simply not good enough.
The judgment confirms that SARS cannot merely issue an assessment or demand payment without providing adequate reasons for its decision. If your evidence has been rejected, SARS should explain why.
Simply repeating its conclusion is not sufficient.
This is an important reminder for every taxpayer. If you receive an adverse assessment or the outcome of a verification or audit that contains little explanation, don't immediately assume your only option is to object. In many cases, your first step should be to request written reasons for SARS' decision.
Understanding why SARS reached its conclusion can often help resolve misunderstandings, strengthen your case, and ensure that your rights are protected.
